Trademark applications are submitted electronically through the DGIP. After filing, the application undergoes a formality examination before being published for two months, allowing third parties to file an opposition if necessary.
If no successful opposition is raised, the application proceeds to substantive examination, where the DGIP evaluates whether the trademark meets Indonesia’s legal requirements. Straightforward applications generally take around 10–12 months from filing to registration, although timelines may vary depending on objections or examination issues.
Once registered, trademark protection is valid for 10 years from the filing date and can be renewed indefinitely every 10 years.
What Foreign Businesses Should Prepare Before Filing
Preparing the right information before filing can significantly improve the registration process.
Foreign applicants typically need to prepare:
- Applicant information and business details
- A clear representation of the trademark
- A list of goods and services based on the Nice Classification
- A signed Power of Attorney when filing through an Indonesian IP consultant
- Priority documents if claiming priority under the Paris Convention
Indonesia is also a member of the Madrid Protocol, allowing eligible businesses to designate Indonesia through an international trademark application. However, applicants should still ensure their application complies with Indonesian examination standards.
